The “New Humanitarianism” and Rule vs. Act Utilitarianism (Consequentialism)

In chapter 3 of Humanitarian Intervention Weiss analyses “new wars” and “new humanitarianisms.”  The changing nature of humanitarian work is characterized by many things, but I’d like to focus on one particularly, which will lead us to a discussion of the importance of neutrality and the concepts of rule and act utilitarianism.

Weiss argues that humanitarian responses, by NGOs particularly,  are becoming more ambitious in scope and thereby shifting from a focus on short-term emergency relief to “attacking the root causes and post-conflict peacebuilding.” He continues,

“rather than provide band-aids, they [humanitarians] wish to use assistance and protection as levers. Many aid agencies desire to spread development, democracy, and human rights and create stable, effective, and legitimate states.” (76)

This has led, concomitantly, to a change in the humanitarian principles of neutrality and impartiality. These principles, Weiss notes, “made sense if the objective was to provide relief and gain access to affected populations.” These principles, it is argued, foundered upon the reality that contemporary wars–“new wars”–were creating “unanticipated and unintended negative consequences.” Moreover, in a world in which the combatants are state militaries, neutrality and impartiality retained some internal logic. However, as genocidaires and other ty[es of rebel groups become the main combatants in civil wars and the predominant perpetrators of crimes against humanity, the principles of neutrality and impartiality come to be seen increasingly as relics of a bygone era.

A few students took issue with this argument, insisting that there are also likely to be unintended consequences of humanitarian organizations repudiating the principles of neutrality and impartiality. They mentioned some of these in class. This prompted a quick excursion by me into the difference between act and rule utilitarianism/consequentialism. I’ll explain below the fold:

Michael Ignatieff and Humanitarian Intervention

Current leader of the Canadian Federal Liberal Party, Michael Ignatieff has long been involved in the issue of human rights–as a historian, journalist, public intellectual, and as the former Carr Professor and Director of the Carr Center for Human Rights Policy at the Kennedy School of Government.

In the aftermath of the contentious NATO military intervention in Kosovo (1999), Ignatieff sat down with WBUR’s Chris Lydon to assess what had gone right (and wrong) during the intervention. A self-identified member of the “something must be done [to stop alleged Serbian war crimes against the Kosovar Albanians]”, Ignatieff stands by his support for the intervention, claiming that, on the whole, the benefits outweighed the costs.

Political Terror Scale

Authoritarian regimes use both “carrots” and “sticks” in order to control their citizens. The “sticks” approach encompasses everything from surveillance to outright physical brutality.  While the use of physical terror to undermine the bodily integrity of their citizens by authoritarian regimes is fairly well known, it is also evident that democracies are not immune to using this form of control over their populations.  Almost by definition, authoritarian regimes terror-prone, but how much more so than democracies. You can fine the answers to this at the Political Terror Scale website, where they have a set of interesting interactive maps.

How is “political terror” defined?  Well, they have created a scale (from 1-5) which is an indicator of the level of political terror citizens in a country face in any given year. The definitions for each of the categories is below.

El Salvador during the 1980s was ruled by a military regime, which used to death squads to “disappear” its internal opponents.  U2 took note:

Level 5 : Terror has expanded to the whole population. The leaders of these societies place no limits on the means or thoroughness with which they pursue personal or ideological goals.
Level 4 : Civil and political rights violations have expanded to large numbers of the population. Murders, disappearances, and torture are a common part of life. In spite of its generality, on this level terror affects those who interest themselves in politics or ideas.
Level 3 : There is extensive political imprisonment, or a recent history of such imprisonment. Execution or other political murders and brutality may be common. Unlimited detention, with or without a trial, for political views is accepted.
Level 2 : There is a limited amount of imprisonment for nonviolent political activity. However, few persons are affected, torture and beatings are exceptional. Political murder is rare.
Level 1 : Countries under a secure rule of law, people are not imprisoned for their view, and torture is rare or exceptional. Political murders are extremely rare.

What are the Fundamental Tenets of Confucianism…Culture as Destiny?

Over the past few weeks, we have addressed the debate regarding the relative explanatory power of cultural versus institutional and rational choice approaches to the analysis of political phenomena.  In the book excerpt, “A Brief History of Human Liberty,” Newsweek editor Fareed Zakaria analyzes the cultural argument regarding economic growth and democracy. He quotes the former Singaporean Prime Minister Lee Kuan Yew:

“…if you want to see how culture works, compare the performance of German workers and Zambian workers anywhere in the world.  You will quickly come to the conclusion that there is something very different in the two cultures that explains the results.”

Zakaria has some sympathy for this argument, but then argues that it is strange that Lee Kuan Yew is such a strong proponent of cultural arguments* given that while Singapore is culturally very similar to its neighbor, Malaysia, Singapore has been much more effective in its economic policies than has its neighbor.  In fact, I would add that a strong argument against cultural explanations of democracy and economic development are the differences between East Germany and West Germany (in the post-WWII-era until unification) and the present difference between North and South Korea.

The 38th parallel may be just a line on a map, and the division of the nation of Korea into two separate states may be a historically contingent act, but it demonstrates the tremendously powerful impact of institutions on a society.  South Korea was able to develop good political and economic institutions, while North Korea has not.  The cultural foundation of each state was similar (although I’m not an expert on Korea, so maybe there was a cultural difference between the “north” and the “south” that can account for the vast differences in the two states today–although I’m highly skeptical) before the division and we know, in a methodological sense, that a constant can not explain an outcome that varies.

Getting back to Zakaria and Lee Yuan Kew, Zakaria writes that

“the key to Singapore’s success…is Lee Kuan Yew, not Confucius.  The point is not that culture is unimportant; on the contrary it matters greatly…But culture can change…A hundred years ago, when East Asia seemed immutably poor, many scholars–most famously Max Weber [we’ve read his Protestant Ethic argument]–argued that Confucian-based cultures discouraged all the attributes necessary for success in capitalism…A decade ago, when East Asia was booming, scholars had turned this explanation on its head, arguing that Confucianism actually emphasized the traits essential for economic dynamism. Today the wheel has turned again and many see in ‘Asian values’ all the ingredients of crony capitalism.”‘

What are these Confucian and ‘Asian values’ about which there has been so much discussion.  Well, needless to say Asia is a vast land mass, with exceedingly high levels of diversity–culturally, linguistically, religiously, racially, etc.  So the concept of ‘Asian values’ may be so amorphous as to http://onpoint.wbur.org/2006/08/15/china-and-confucian-democracy http://onpoint.wbur.org/2006/08/http://onpoint.wbur.org/2006/08/15/china-and-confucian-democracy/china-and-confucian-democracy.  Confucianism, however, is a distinct and compact body of ideas that has a comprehensive philosophical foundation.  What are Confucian values, then and do they help or hinder China’s precarious journey towards democracy and economic development?  Well, here’s an answer from political philosopher Daniel Bell, who insists that ultimately, Confucianism is about three core values.  What are these?  Listen to the first ten minutes of the audio podcast from this episode of “On Point.”  Here’s a link to the URL on which you can find an archived version of the show.

**Here, it should be noted that a reason Lee Kuan Yew is strongly predisposed to arguing on the basis of culture is his contempt for the licentiousness of Western values and his desire to prevent demands for those kinds of freedoms (as long as political liberty) to take root in the strongly authoritarian state of Singapore.  Just read his statements during the infamous Michael Fay incident.

It wasn’t long before Singapore patriarch Lee Kuan Yew weighed in. He reckoned the whole affair revealed America’s moral decay. “The U.S. government, the U.S. Senate and the U.S. media took the opportunity to ridicule us, saying the sentence was too severe,” he said in a television interview. “[The U.S.] does not restrain or punish individuals, forgiving them for whatever they have done. That’s why the whole country is in chaos: drugs, violence, unemployment and homelessness. The American society is the richest and most prosperous in the world but it is hardly safe and peaceful.”

Monty Python’s take on Constitutional Government

I am a huge fan of the British sketch comedy group Monty Python.  For a political science professor, this clip is like politico-comedic gold.  Here is Dennis the peasant’s views on democratic legitimacy, the proper role of popular mandates in the wielding of supreme executive power, and a sarcastic critique of socialist critiques of liberal capitalism (“oh, there you go bringing class into it again!”).  And remember, “you don’t vote for kings.”

Japanese American Internment During World War II

Students in my Intro to IR class have turned in papers dealing with ethics in international relations. One of the papers has an interesting quote by a Lieutenant General John L. DeWitt (who [my student claims] ultimately ordered the internment).

According to my student (AA), this is what Lt-Gen. DeWitt said to members of a Congressional panel:

“I don’t want any of them [persons of Japanese ancestry] here. They are a dangerous element. There is no way to determine their loyalty… It makes no difference whether he is an American citizen, he is still Japanese. American citizenship does not necessarily determine loyalty… But we must worry about the Japanese all the time until he is wiped off the map” (Mullen)*.

Pope Benedict XVI a Foreign Policy Radical

The Pope delivered a speech last week to the United Nations in which he argued–as have many radicals over the last few decades–that the will of the international community to act in order to solve important global problems is being undermined because a few states have accrued too much power.  The Associated Press has more:

NEW YORK – Pope Benedict XVI warned diplomats at the United Nations on Friday that international cooperation needed to solve urgent problems is “in crisis” because decisions rest in the hands of a few powerful nations.

In a major speech on his U.S. trip, Benedict also said that respect for human rights, not violence, was the key to solving many of the world’s problems.

While he didn’t identify the countries that have a stranglehold on global power, the German pope — just the third pontiff to address the U.N. General Assembly — addressed long-standing Vatican concerns about the struggle to achieve world peace and the development of the poorest regions.

On the one hand, he said, collective action by the international community is needed to solve the planet’s greatest challenges.

On the other, “we experience the obvious paradox of a multilateral consensus that continues to be in crisis because it is still subordinated to the decisions of a few.”

The pope made no mention of the United States in his speech, though the Vatican did not support the U.S.-led invasion of Iraq in 2003, which occurred despite the Bush administration’s failure to gain Security Council approval for it. At other moments on his trip, Benedict has been overtly critical of the U.S., noting how opportunity and hope have not always been available to minorities.

The pope said questions of security, development and protection of the environment require international leaders to work together in good faith, particularly when dealing with Africa and other underdeveloped areas vulnerable to “the negative effects of globalization.”

Newsweek Editor Fareed Zakaria Says “No” to Olympic Boycott

In a recent column, Newsweek’s Fareed Zakaria argues that the US should not boycott the Olympic Games in Beijing this summer.  He argues that it would have the opposite of the intended effect.  Here are some snippets:

Public humiliation does not work nearly as well on the regime in Beijing as private pressure. At first glance, China’s recent crackdown in Tibet looks like a familiar storyline: a dictatorship represses its people. And of course that’s part of the reality — as it often is in China. But on this issue, the communist regime is not in opposition to its people. The vast majority of Chinese have little sympathy for the Tibetan cause. To the extent that we can gauge public opinion in China and among its diaspora, ordinary Chinese are, if anything, critical of the Beijing government for being too easy on the Tibetans. The real struggle here is between a nationalist majority and an ethnic and religious minority looking to secure its rights.

In these circumstances, a boycott of the Olympics would have precisely the opposite effect that is intended. The regime in Beijing would become only more defensive and stubborn. The Chinese people would rally around the flag and see the West as trying to humiliate China in its first international moment of glory. (There are many suspicions that the United States cannot abide the prospect of a rising China.) For most Chinese, the Games are about the world’s giving China respect, rather than bolstering the Communist Party’s legitimacy…

…Some want to punish China for its association with the Sudanese government, which is perpetrating atrocities in Darfur. But to boycott Beijing’s Games because it buys oil from Sudan carries the notion of responsibility too far. After all, the United States has much closer ties to Saudi Arabia, a medieval monarchy that has funded Islamic terror. Should the world boycott America for this relationship?

Reagan to Gorbachev–“Tear Down This Wall”

Getting ready for our mock German election tomorrow has me thinking about the German political system, the respective political parties, and German reunification.  It reminded me of this famous speech by President Ronald Reagan at Brandenburg Gate in (West) Berlin.

60 Minutes Report on Torture in Guantanamo Bay

Via the CBS news program 60 Minutes, we learn about a German resident of Turkish origin who was tortured by his captors in Afghanistan and Guantanamo Bay.  From the description:

An innocent man held as a terror detainee for years tells Scott Pelley, in his first U.S. television interview, how Americans tortured him in Afghanistan and then at Guantanamo Bay.
